Humans as social beings cannot be separated from the political dimension of their lives, where ethics play an important role in the decision- making process and the management of society. In Islam, politics is seen as part of worship so that it must be based on religious principles. Ibn Khaldun emphasized the importance of the state running fairly and honestly based on religious morals and ethics to ensure development in various sectors of life. This research uses a qualitative approach with a literature study method, utilizing data sources from various literature, theories, research, and documents. Content analysis of Ibn Khaldun's works and related literature is used to explore the implementation of political ethics in Indonesia. The results show that the implementation of Islamic political ethics in Indonesia is guided by Pancasila as the basis of the state that reflects moral and ethical values in politics. The application of political ethics is expected to form a civilized, just, democratic, respectful and prosperous society.
M. Yusran S, Nurul Azizah, M. Islam clearly regulates what can and cannot be done in business activities, the Koran explains that rights and falsehood should not be mixed, if there is any doubt in making a choice it is recommended to leave. As is the case with business practices that are prohibited in Islam in the form of product or service fraud. In essence, Islam does not allow an activity of distribution and production of goods or services that does not provide information about goods or services honestly and transparently. Unlimited guarantee for Tupperwere products in Mensemat hamlet, Mekarjaya village. This research uses a qualitative method, namely research that uses methods, steps, and procedures that involve data and information obtained through respondents as subjects who can express their own answers and feelings to get a holistic general picture of the thing being studied. Based on the research results, in reviewing Islamic law regarding consumer protection in the unlimited guarantee for Tupperwere products, there is an element of non-disclosure between producers and consumers regarding the provision of guarantees. When the contract takes place, the manufacturer does not explain the warranty provisions in detail, giving rise to an element of gharar or fraud. Meanwhile, in this case, the contract does not fully meet the criteria for openness. Consumers do not get a guarantee letter when purchasing Tupperware products
Ila Irvina Copyright (c) 2024 Archipelago Journal of Southeast Asia Islamic Studies https://journal.iaisambas.ac.id/index.php/archipelago/workflow/index/3129/5 https://journal.iaisambas.ac.id/index.php/archipelago/article/view/3129 Fri, 09 Aug 2024 03:05:51 +0000 IMPLEMENTATION OF SAMBAS REGENT REGULATION NUMBER 18 OF 2018 CONCERNING ENVIRONMENTAL PERMITS FOR GOLD MINING IN TEBING BATU VILLAGE https://journal.iaisambas.ac.id/index.php/archipelago/article/view/3130
This research was motivated by the existence of a gold mining business managed by a group of communities in Tebing Batu Village, Sambas Regency. The mine has been established for a long time but some do not have environmental permits from either the Village Government or the District Government. Meanwhile, in Sambas Regency, there are laws and regulations governing environmental permits, namely Regent Regulation Number 18 of 2018 concerning Environmental Permits. The objectives of this study are twofold, namely: to determine the implementation of Regent Regulation Number 18 of 2018 concerning Environmental Permits for Gold Mining in Tebing Batu Village; and to assess the legal consequences of mining activities in Tebing Batu Village based on Sambas Regent Regulation Number 18 of 2018 concerning Environmental Permits. This research uses a descriptive method, namely research that uses an overview of the facts, nature, and relationships between the events studied. This type of research is qualitative which is field research. This research also includes empirical legal research that examines social issues in terms of laws and regulations, namely Sambas Regent Regulation No. 18 of 2018 concerning Environmental Permits. To obtain research data, researchers used interview and observation techniques. The findings of this study are that the implementation of Sambas Regent Regulation Number 18 of 2018 concerning Environmental Permits is still not optimal because there is a mining business that does not have a business license and is not yet required AMDAL where environmental permits are the initial instrument for issuing business permits. The legal consequence is that the mining business is actually not fit to operate because it does not have an environmental permit so that parties involved in the mining business can be subject to administrative and even criminal sanctions
Nurkarima Copyright (c) 2024 Archipelago Journal of Southeast Asia Islamic Studies https://journal.iaisambas.ac.id/index.php/archipelago/workflow/index/3130/5 https://journal.iaisambas.ac.id/index.php/archipelago/article/view/3130 Fri, 09 Aug 2024 03:16:03 +0000 VALUES OF ISLAMIC EDUCATION IN BOOKS FINALLY I FOUND TRUE HAPPINESS KARYA DR. This research aims to explore how these values can influence public policy in different countries, especially the Muslim majority. This research uses a literature method with an Islamic law approach. The research will begin by conducting a comprehensive literature review of primary and secondary sources, including Islamic classics, scientific journals, books on Islamic political ethics, as well as public policy articles and reports. The results of the study show that universal values such as justice ('adl), benefit (maslahah), accountability (amanah), wisdom (hikmah), and public participation (shura) have significant relevance in the context of public policy formation. These values can help create policies that are more just, inclusive, and oriented towards community welfare. However, the application of these values is inseparable from various challenges, such as pluralistic contexts, diverse interpretations, and incompatibility with contemporary conditions
Astri Aulia, Afriani, Tari Lestari, Kurniati Copyright (c) 2024 Archipelago Journal of Southeast Asia Islamic Studies https://journal.iaisambas.ac.id/index.php/archipelago/workflow/index/3132/5 https://journal.iaisambas.ac.id/index.php/archipelago/article/view/3132 Fri, 09 Aug 2024 03:34:13 +0000 HEIRS OF DIFFERENT RELIGIONS FROM THE PERSPECTIVE OF YŪSUF AL-QARḌĀWĪ AND WAHBAH AL-ZUḤAILĪ https://journal.iaisambas.ac.id/index.php/archipelago/article/view/3204
This research discusses the views of contemporary scholars, namely Yūsuf al-Qarḍāwī and Wahbah Al-Zuḥailī have their own provisions in the inheritance law of different religions. The provisions of the law of inheritance of different religions according to Yūsuf al-Qarḍāwī are, first, allowing Muslims to inherit property from disbelievers dhimmī. Second, a person who converts to Islam before the distribution of inheritance is still entitled to receive inheritance. Third, because of trust, a person who frees his pagan slave is entitled to receive an inheritance. Meanwhile, the provisions of the law of inheritance of different religions according to Wahbah Al-Zuḥailī are prohibited for muslims to inherit property from non-Muslims (kafirs) absolutely for any reason, because it is to protect walayah from being cut off between muslims and non-Muslims. The focus of this study is how yūsuf al-qarḍāwī and Wahbah al-zuḥailī view the inheritance of different religions. Meanwhile, the method in this study is to use a literature approach. As a result of this study, Yūsuf al-Qarḍāwī forbade inheritance of different religions if the inheritance is given to the infidels of the ḥarbi. Wahbah al-Zuḥailī agrees with the hadith of the Prophet (saw), about the permissibility of non-Muslims to inherit Muslims, and vice versa, and as a form of reciting muṭlaq. Because the word "infidel" in the hadith of the Prophet (saw) is affirmed for all disbelievers without exception.
Asman Copyright (c) 2024 Archipelago Journal of Southeast Asia Islamic Studies https://journal.iaisambas.ac.id/index.php/archipelago/workflow/index/3204/5 https://journal.iaisambas.ac.id/index.php/archipelago/article/view/3204 Tue, 10 Sep 2024 08:50:43 +0000
